Please read these Terms of Service (“Terms”) carefully before using the Bluegrass Advanced Mental Health website (the “Website”) operated by Bluegrass Advanced Mental Health (“Bluegrass,” “we,” “us,” or “our”). These Terms contain important information regarding limitations of liability, permitted use, and dispute resolution. Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website.

Any additional agreements (for example, separate patient registration or telehealth consents) may contain terms that supplement these Terms.


Website purpose; no medical advice; emergencies


The Website provides general information about Bluegrass and our services and may allow you to request appointments, benefits checks, or submit non-urgent communications. The Website does not provide medical advice and is not a substitute for professional diagnosis or treatment. Never rely solely on Website content for medical decisions. Always consult a qualified health professional for medical care.


The Website is not for urgent or emergency communications. If you are experiencing an emergency or are in immediate danger, call 911. If you are in crisis or considering harming yourself or others, call 988 (U.S.) or go to the nearest emergency room immediately.

Submitting a form or message through the Website does not create a provider–patient relationship. Clinical relationships are established only through an explicit clinician agreement and, where applicable, in-person or telehealth clinical encounters that include consent and medical record documentation.


Privacy, HIPAA, and medical records

These Terms and the Privacy Policy do not govern your medical record or clinical information. Services, offers, and pricing


Bluegrass provides information about a range of psychiatric and mental health services, which may include, as clinically appropriate: psychiatric evaluation and consultation, psychotherapy, medication management, Deep TMS and accelerated TMS protocols, Spravato® (esketamine) administered under REMS conditions, neurostimulation consultations, and related clinical supports.

Insurance & self-pay: Pricing and coverage depend on your insurance benefits and whether you are self-pay. Benefits, prior authorization requirements, and out-of-pocket costs vary by plan and are confirmed individually. Upon request, Bluegrass may provide written estimates for eligible services before care begins; estimates are not guarantees and may change based on medical necessity, payer rules, documentation, and other factors.

Bluegrass may change service offerings, pricing, or availability at any time.


Appointment requests, eligibility, and communications


If the Website permits you to request appointments, consultations, or eligibility checks, you agree that:

You will provide accurate, truthful, and current information.

We may contact you by phone, email, or text to follow up on your request, schedule visits, or confirm benefits.

Submitting a request does not guarantee an appointment, authorization, or insurance coverage.


Cancellations, late arrivals, and no-shows


Appointment slots are reserved for you. Our cancellation, late arrival, and no-show policies (including applicable fees) are provided when you schedule and in our patient materials. If you have questions about the current policy, contact our office before your appointment.


Refund policy


We do not issue refunds for services already rendered. Prepayments for future services are handled per our cancellation policy and applicable payer rules. Bluegrass reserves the right to cancel or reschedule an appointment or service for reasons of safety, eligibility, or availability; if Bluegrass cancels a prepaid service before it is provided, we will refund the amount received for that service unless a non-refundable fee was disclosed in advance.


Accounts and security (if applicable)


If the Website allows you to create an account, you represent that you are 18 years or older and that the information you provide is accurate and current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify Bluegrass promptly of any unauthorized use. Bluegrass may suspend or terminate accounts for any reason.

Governing law; dispute resolution; venue; class action waiver


These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any claim arising from or relating to these Terms or the Website shall be brought only in the state or federal courts located in Jefferson County, Kentucky, and you and Bluegrass agree to submit to the jurisdiction of those courts. You and Bluegrass each agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not constitute a waiver.

These Terms constitute the entire agreement between you and Bluegrass with respect to the Website and supersede prior website-related agreements.


Changes to these Terms


Bluegrass may update these Terms at any time. Changes are effective when posted to the Website. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
